Purchase Fees and Disbursements

Purchase of a freehold residential property

Our fees cover all of the work required to complete the purchase of your new home, including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property you wish to buy is in Wales.

In the event that a transaction becomes particularly complicated or protracted we may increase the level of our estimate, although we will only do so having told you first.

 

Additional legal fees where a mortgage is being obtained: £175.00 plus VAT (£210 inclusive of VAT)

(These costs are for dealing with the requirements of the mortgage lender but are payable by the person buying the property.)

 

Search fees: £275.00 - £405.00 (inclusive of VAT)

(This means the local search, drainage search, environmental search and metalliferous mining search and the level of these costs can depend on the exact location and size of the property.)

 

HM Land Registry registration fee: £40.00 - £910.00 (Non-Vatable)

(This will be dependent on the value of the property and whether or not an application can be made via the Land Registry Portal.)

 

Electronic money transfer fee: £30.00 inclusive of VAT (£25.00 plus VAT)

This is made up of a disbursement of £15 plus VAT (£18.00) being the fee charged us by our bank for transferring funds electronically and an administrative fee of £10 plus VAT (£12.00).

 

Land Registration searches and bankruptcy searches: £3.00 - £6.00 (Not vatable)

(These searches are carried out immediately prior to completion.)

Disbursements are costs related to your matter that are payable to third parties, such as Land Registry fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

 

Stamp Duty or Land Tax (on purchase)

This depends on the purchase price of your property. You can calculate the amount you will need to pay by using HMRC's website or if the property is located in Wales by using the Welsh Revenue Authority’s website.

 

Stages of the process

The precise stages involved in the purchase of a residential property vary according to the circumstances.

  • Take your instructions and give you initial advice
  • Check finances are in place to fund purchase and contact lender's solicitors if needed
  • Receive and advise on contract documents
  • Carry out searches
  • Obtain further planning documentation if required
  • Make any necessary enquiries of seller's solicitor
  • Give you advice on all documents and information received
  • Go through conditions of mortgage offer with you
  • Send final contract to you for signature
  • Agree completion date (date from which you own the property)
  • Exchange contracts and notify you that this has happened
  • Arrange for all monies needed to be received from lender and you
  • Complete purchase
  • Deal with payment of Stamp Duty/Land Tax
  • Deal with application for registration at Land Registry

There are certain disbursements which will be set out in the individual lease relating to the Property. The disbursements which we anticipate will apply are set out separately below. This list is not exhaustive and other disbursements may apply depending on the term of the lease. We will update you on the specific fees upon receipt and review of the lease from the seller's solicitors.

Certificate of Compliance: £50.00 - £200.00 (inclusive of VAT)
Notice of assignment and charge: £100.00 - £300.00 (inclusive of VAT)
Deed of Covenant: £150.00 - £350.00 (inclusive of VAT)
Licence to Assign: £300.00 - £500.00 (inclusive of VAT)

The amounts quoted for our legal fees above assumes that:

  • this is a standard transaction and that no unforeseen matters arise including for example (but not limited to) a defect in title which requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction
  • this is the assignment of an existing lease and is not the grant of a new lease
  • the transaction is concluded in a timely manner and no unforeseen complication arise
  • all parties to the transaction are co-operative and there is no unreasonable delay from third parties providing documentation
  • no indemnity policies are required. Additional disbursements may apply if indemnity policies are required.

(This will depend on how complicated the title is and how many documents are referred to in the Land Registry title.)

 

Electronic money transfer fee: £30.00 inclusive of VAT (£25.00 plus VAT)

(This is made up of a disbursement of £15 plus VAT (£18.00) being the fee charged us by our bank for transferring funds electronically and an administrative fee of £10 plus VAT (£12.00).)

  • Obtain further planning documentation if required
  • Answer any enquiries made by buyer’s solicitor
  • Give you advice on all documents and information received
  • Send final contract to you for signature
  • Agree completion date (date from which you no longer own the property)
  • Exchange contracts and notify you that this has happened
  • Arrange for a redemption statement of any existing mortgage to be obtained
  • Complete sale
  • Pay estate agents commission

 

 

Sale of a residential leasehold property

Generally our fees will be the same as for acting on the sale of a freehold property but there will be an addition expense which will be to obtain information about the way in which the property is managed from the landlord and/or the managing agent. The landlord and/or the managing agent will generally charge a fee for this information which can vary between £200.00 to more than £500.00 (inclusive of VAT).

 

Remortgage of a residential freehold or leasehold property (including equity release)

Legal Fees: £400.00 plus VAT (£480.00 inclusive of VAT)

(This is regardless of the value of the property.)

 

Search fees: £275.00 - £405.00 (inclusive of VAT)

(This means the local search, drainage search, environmental search and metalliferous mining search and the level of these costs can depend on the exact location and size of the property.)

 

No-Search Indemnity Insurance premium: £20.00 - £200.00 (Non-Vatable)

(Most mortgage lenders will accept no-search indemnity insurance on a remortgage instead of carrying out the searches noted above.)
