As of 20
May 2010 the Home Information Pack requirements and penalties have been
suspended.
However, a home owner must instruct someone to provide an Energy
Performance Certificate (EPC) before a property is offered for sale, if
they do not already have such a certificate.
This means that the Domestic Energy Assessor (DEA) must have been
instructed to prepare the EPC and either been paid for it or received a
clear undertaking from the homeowner to pay.
An agent acting for the prospective Seller must ensure that the EPC
arrangements have been made before marketing commences.
Both the Seller and the Agents must make "reasonable efforts" to obtain
the EPC within 28 days.
There are penalties for breaching these requirements.
